Terms & Conditions

1. DEFINITIONS
"Company" means Serenity Realtors.
"Client" means any person, company, purchaser, vendor, landlord, tenant, developer, or investor who engages the services of Serenity Realtors.
"Property" means any land, house, apartment, commercial building, development, or real estate interest listed, marketed, sold, rented, or managed by Serenity Realtors.
2. ACCEPTANCE OF TERMS
By engaging Serenity Realtors, using our website, viewing our listings, requesting information, or entering into any agreement with us, you agree to be bound by these Terms and Conditions.

3. SERVICES PROVIDED
Serenity Realtors may provide:
Property sales and marketing, Property rentals and leasing, Property management, Real estate consulting,
Property valuation referrals, Buyer representation, Seller representation, Real estate advertising and promotion, Assistance with property transactions All services are subject to applicable laws of Grenada.
4. PROPERTY INFORMATION
While Serenity Realtors makes reasonable efforts to verify information provided by property owners, the Company does not guarantee the accuracy of:
Property boundaries, Lot size, Building dimensions, Zoning status, Planning approvals, Structural condition,
Utilities and services, Ownership claims.
Clients are encouraged to conduct independent inspections, surveys, legal investigations, and due diligence before entering into any transaction. 

5. NO LEGAL OR FINANCIAL ADVICE
Serenity Realtors is not a law firm, accounting firm, or financial institution.
Any information provided by the Company is for general guidance only and shall not be considered legal, tax, accounting, financial, engineering, or valuation advice.
Clients should seek advice from qualified attorneys, accountants, surveyors, valuators, and financial professionals.

6. COMMISSIONS AND FEES
Commission rates and service fees shall be governed by separate written agreements.
The Client agrees to pay all commissions, marketing fees, administrative charges, and related costs as agreed in writing.
Failure to pay fees may result in legal action and recovery of collection costs.

7. EXCLUSIVE LISTINGS
Where a property owner enters into an Exclusive Listing Agreement with Serenity Realtors:
The Company shall have exclusive rights to market the property during the agreed period.
Commissions remain payable if a purchaser is introduced during the listing period.
The owner shall not engage another agent without written consent.
8. BUYER RESPONSIBILITIES
Purchasers are responsible for:
Obtaining financing
Conducting inspections
Reviewing title documents
Reviewing surveys and plans
Obtaining legal advice
Confirming planning and development approvals
Serenity Realtors shall not be liable for defects discovered after purchase.
9. SELLER RESPONSIBILITIES
Property owners warrant that:
They are legally entitled to market the property.
Information provided is accurate to the best of their knowledge.
Material defects are disclosed.
The property is free from undisclosed claims or disputes.
10. FOREIGN PURCHASERS
Foreign nationals purchasing property in Grenada may be subject to licensing, regulatory approvals, government fees, and other legal requirements.
Serenity Realtors shall not be responsible for delays or refusals by government authorities. Foreign buyers should obtain independent legal advice.

11. PRIVACY AND CONFIDENTIALITY
Serenity Realtors shall take reasonable steps to protect client information.
Personal information may be collected and used for:
Property transactions
Marketing communications
Client verification
Legal compliance
Regulatory requirements
Information may be disclosed where required by law or court order.

12. ANTI-FRAUD AND COMPLIANCE
The Company reserves the right to verify:
Identity documents
Ownership documents
Source of funds
Corporate records
Regulatory compliance requirements
Transactions suspected of fraud, money laundering, or unlawful activity may be reported to the appropriate authorities.

13. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Serenity Realtors shall not be liable for:
Errors in property information
Delays in transactions
Loss of profits
Loss of business opportunities
Actions of third parties
Government decisions
Market fluctuations
Survey or title defects
The Company's liability shall be limited to the amount of fees actually paid to Serenity Realtors for the specific service.

14. INTELLECTUAL PROPERTY
All photographs, videos, logos, branding materials, advertisements, listing descriptions, website content, and marketing materials remain the property of Serenity Realtors unless otherwise agreed in writing.
Unauthorized reproduction or use is prohibited.

15. TERMINATION
Serenity Realtors may terminate services where:
False information is provided.
Fees remain unpaid.
Fraudulent conduct is suspected.
The Client breaches these Terms and Conditions.
16. DISPUTE RESOLUTION
Parties shall first attempt to resolve disputes through good-faith negotiation.
Where resolution cannot be achieved, disputes shall be submitted to mediation or referred to the courts of Grenada.

17. GOVERNING LAW
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Grenada, including applicable property, contract, and land registration legislation.
18. AMENDMENTS
Serenity Realtors reserves the right to amend these Terms and Conditions at any time. Updated versions shall become effective upon publication.
